01 These terms
These terms are between you and promyphoto.app ("ProMyPhoto", "we", "us"). By joining early access or using the app, you agree to them. If you do not agree, do not use ProMyPhoto. We may update these terms as the product grows, and will change the date at the top when we do.
02 A product that keeps changing
ProMyPhoto is a live product that is still developing quickly. That means:
- Features change, and new ones arrive often.
- We may change, pause or remove features. Where a change materially reduces what you have paid for, we will tell you first.
We will give reasonable notice before any change that materially affects paid credits you already hold.
03 Your account
You are responsible for your account and for keeping your sign-in secure. Use ProMyPhoto only for property and listing photography you are allowed to shoot. You must have the right to photograph and share the properties you capture.
04 Credits and how they work
ProMyPhoto runs on credits.
- One credit equals one finished photo. A credit is spent when you finish a photo. Capturing, storing and re-downloading photos costs nothing.
- Your monthly allowance. Every paid plan includes an allowance of credits that is refilled at the start of each billing month. An allowance is rented, not owned: it expires at each refill. See section 05.
- Credits you buy outright. Credit packs, the free credits new accounts start with, promotional credits and credits we grant you through support are yours to keep and never expire while your account is open.
- Top-ups. You can buy additional credits at any time, on any plan. Top-up credits are bought outright, so they roll over.
- Pooling on agency accounts. Agency credits are shared across every seat: any agent on the account can spend from the same pool, and there is no per-seat allocation. The head seat adds and removes colleagues themselves. See section 07.
- Credits have no cash value. They are not transferable between accounts, cannot be sold, and are not redeemable for money.
05 When credits expire — please read
This is the part of the credit model people are most often surprised by, so it has its own section rather than a line inside another one.
- Your monthly allowance expires when it refills. On the day your plan renews, your allowance is reset to the full amount for the new month. Anything left over from the month before is gone. It does not roll over, it does not bank, and it is not refunded.
- Credits you bought outright never expire. Packs, your free starting credits, promotional credits and support grants sit alongside your allowance and stay there until you spend them or close your account.
- Allowance is spent first. When you finish a photo we take the credit from your monthly allowance while there is one left, and only then from credits you bought. That way the credits that are about to expire are the ones used up.
An example, because the arithmetic is the whole point. A plan that includes 60 credits a month, on which you finish 45 photos, loses the other 15 at the next renewal. They are not carried forward and they are not refunded.
If your usage is regularly below your plan, the fix is to move to a smaller monthly plan rather than to bank credits — you can change plan at any renewal.
Nothing in this section limits rights you have under the Australian Consumer Law that cannot be excluded.
06 Payments and refunds
- Prices are in Australian dollars and include GST unless stated otherwise.
- Paid plans bill in advance for the billing period you choose.
- Plans renew automatically. A monthly plan renews every month, and we charge the payment method you gave us on the renewal date, at the price shown when you subscribed, until you cancel. We will email you before any price change and you can cancel first.
- Cancelling is immediate and self-serve. Cancel any time from your account, or from your Apple subscription settings if you subscribed on iPhone. Cancelling stops the next charge; your plan keeps working until the end of the period you have already paid for.
- Spent credits are not refundable. Once a credit has finished a photo, the work is done and the credit is used.
- You can cancel a plan to stop future billing. Cancelling does not refund the current period or credits already spent.
- Nothing here limits rights you have under the Australian Consumer Law that cannot be excluded.
07 Agency accounts
An agency account is one shared pool of credits that several agents spend from, on one bill. Everything else on this page applies to it as well; this section says what is different.
Who the agreement is with
- The agreement is with the agency, not with the individual agents seated on it. If you set one up on behalf of a business, you confirm you are authorised to commit that business to it.
- The account has one head seat. Only the head seat can see or change billing, buy credits, add and remove colleagues, or cancel. Everyone else on the account can shoot and spend, and nothing more.
- The head seat can hand the role to any colleague already seated on the account, from the agency page, at any time. We do not change it for you except where an agency has been left with no head seat at all.
What it costs
- Agency plans are not sold at a published price. You tell us the size of the plan you want, anywhere from 200 to 5,000 credits a month, and we agree the monthly price with you by email before anything is set up. The agreed price is shown in full on the payment page before you pay, and it includes GST. To start, email hello@promyphoto.app.
- Seats are free. We charge for finished photos, not for people. Accounts start with a ceiling of 100 seats, which exists to stop abuse rather than to sell you seats; email hello@promyphoto.app and we will lift it.
- Agency plans are arranged with us by email and paid for on this website only. They are not sold through the App Store and cannot be started, changed or topped up inside the iOS app.
Credits on an agency account
- The monthly allowance behaves exactly as section 05 describes: it is refilled each month and whatever is left of it expires at the refill. Credits the agency buys outright as top-up packs sit alongside it and do not expire while the account is open.
- When a seated agent finishes a photo, the credit comes from whatever is about to expire first — their own expiring credits before the agency’s — then from credits they bought themselves, and only then from the agency’s pool. Nobody loses credits they paid for by joining an agency, and nothing sits unspent while a rented credit expires beside it.
- If a photo or an edit fails, the credit goes back to whichever balance paid for it, including after that person has left the agency.
- Credits an agent pays for themselves are not billed to the agency and do not appear in what the agency is shown they spent.
If you are already on a monthly plan
- Setting up an agency stops your existing Starter or Pro plan from renewing, automatically, as soon as the agency’s first invoice is paid. It is not optional and it is not a separate step.
- It is not refunded and not pro-rated. The old plan keeps working, with its credits, until the end of the period you have already paid for, and those credits are spent before the agency’s pool is touched. Nothing you paid for is lost.
- If your existing subscription is billed by Apple we cannot set up the agency, because Apple lets only you cancel an App Store subscription. Cancel it on your iPhone first and nothing will have been created or charged in the meantime.
Cancelling, and leaving
- The head seat can cancel at any time from the billing portal. The agency keeps its monthly allowance to the end of the period it has already paid for, and after that the allowance stops being refilled and whatever is left of it is gone. It is not refunded.
- Credits the agency bought outright are not part of that allowance, and cancelling a plan does not close the account, so they remain under section 04.
- Removing a seat takes effect immediately: that person goes back to an ordinary account with their own credits, keeps the photos in it, and stops being able to spend from the pool. Work already finished stays where it is, and credits already spent are not returned.
- If the head seat deletes their ProMyPhoto account while colleagues are still seated, we refuse the deletion and ask them to make someone else the head seat first — otherwise the agency would be left with a bill nobody can pay. If they are the only seat, the agency is dissolved with them and its plan is cancelled; anything left in the pool at that point goes with it and is not refunded.
Nothing in this section limits rights you have under the Australian Consumer Law that cannot be excluded.
08 Acceptable use
Do not use ProMyPhoto to:
- Photograph property you have no right to photograph or publish.
- Create misleading imagery that misrepresents a property in a listing.
- Break the law, infringe someone's rights, or breach a platform's rules (including realestate.com.au).
- Attack, overload, reverse-engineer, or resell the service.
We may suspend accounts that break these rules.
09 Your content
Your photos are yours. You keep ownership of the property images you capture and the finished photos we return. You grant us the limited permission needed to process, store, and deliver them back to you. We do not use your property photos to train public models or publish them. See our Privacy Policy for detail.
10 Service availability
Capture works on your phone offline. Finishing photos needs connectivity and our cloud pipeline, which depends on third-party providers. We aim for high availability but do not promise the service will be uninterrupted or error-free, especially during early access. If a finish fails, we will surface the error and, where a credit was charged for work that did not complete, credit it back.
11 Liability
ProMyPhoto is provided "as is" during early access. To the extent the law allows, we are not liable for indirect or consequential loss (such as lost sales or lost listings). Where liability cannot be excluded, our total liability to you is limited to the amount you paid ProMyPhoto in the three months before the claim. This does not limit rights under the Australian Consumer Law that cannot be excluded.
