Creator terms

01 These terms

These terms are between you and ProMyPhoto (ABN 81 362 647 373) (“ProMyPhoto”, “we”, “us”) and cover the creator program described at promyphoto.app/creators. You agree to them when you apply. Our Terms of Service and Privacy Policy also apply.

02 Commission

• You earn 15% of what each customer you refer pays us, for 12 months from the day they first use your code or link.
• Commission is worked out on what we actually receive: after GST, and after Apple’s share on App Store purchases.
• A customer belongs to the first creator code they use. That does not change later.

03 View bounties

• A video earns a bounty on its views 7 days after you post it: 10,000 views A$25, 25,000 A$75, 100,000 A$200, 250,000 or more A$400.
• Views are the number Instagram or TikTok shows when we check at day 7.
• Each video is paid once, on its views at day 7. There is no monthly cap on bounties.
• Organic views only. No paid boosting, no bought views. We decide whether a video qualifies.

04 How you are paid

• We work out your commission and bounties and pay them to you ourselves.
• We'll explain how and when you are paid on a short call once you're in.

05 ABN and GST

Australian creators need an ABN to join: your own, or your agency’s if your agency is the one we pay. It is free at abr.gov.au. We do not pay an Australian creator without one. If you are registered for GST, we may ask you to agree to recipient created tax invoices, so you do not have to invoice us.

06 Say it is an ad

Every post you are paid for must clearly say it is an ad, visible without opening the caption: use #ad or the platform’s Paid partnership label. Only say what is true about ProMyPhoto. If you are unsure about a post, send it to us first.

07 Fair play

Referring yourself, fake or duplicate accounts, and buying then refunding to earn commission are not allowed. If we find any of these, we may withhold or permanently keep the commission and bounties earned that way, recover amounts already paid from your future payouts, and end your place in the program. We will tell you which lines were withheld and why.

08 Your status

• You take part as an independent contractor, not as our employee. You are responsible for your own tax.
• If you work for an agency or an employer, you are responsible for making sure they allow you to take part.

09 Changes and ending

We can change these terms with 30 days’ notice by email. You can leave the program at any time by telling us. Commission and bounties you earned fairly before you leave are still paid.
